Concerns Grow Over Nuclear Plants Here in the U.S. and Condolences for the Workers and People of Japan

The recent headlines coming out of Japan raise serious concerns for the workers who are being exposed to high levels of radiation. Many people around the world are just now beginning to ask themselves, ‘what will happen to those workers’ and ‘what will the experience and the aftermath of their exposure mean to themselves and their families’.

Exposure of any type of radiation, especially of this magnitude, is not only a concern for the workers, but for the residents. The Environmental Protection Agency (EPA) has released information on their website, ‘Radiation Doses in Perspective,’ to give people a sense of what this type of exposure may mean for the people of Japan (http://www.epa.gov/radiation/understand/perspective.html).

According to reports, the government of Japan has established a 20km exclusion zone and evacuated tens of thousands of people. Those living up to 30km away have been told to stay indoors to minimize exposure. Though the U.S. State Department released a statement on March 16, 2011, warning American citizens of the potential risk of radiation exposure and asking that they leave Japan, many residents as well as U.S. military have remained. The issue of power plants and the vicinity to residents all across the U.S. is now becoming a highly publicized topic of major concern, as citizens begin to question how a natural disaster of this magnitude would impact the millions of residents who live within a 20kn radius of nuclear plants here.

Days since this crisis, news reports continue to unfold. According to a Press Release that was issued today over the Dow Jones Newswire, “the safety of U.S. nuclear facilities has come under question in recent days as the nuclear crisis at Japan’s Fukushima plant reveal weaknesses in nuclear plant technology and operations. The Nuclear Regulatory Commission voted Wednesday to conduct a major safety review of the 104 nuclear reactors operating in the US.

The statement goes on to say, “The Nuclear Regulatory Commission has been aware of (the) reporting lapses since at least 2009. In that time, the commission identified 24 instances, between December 2009 and September 2010, in which nuclear plants did not report the emerging defects under Part 21.”

These instances pose “a substantial safety hazard” and prevent federal regulators from spotting manufacturer defects that could surface at other plants around the country, the inspector general said.

Because US plants are failing to report defects as a result of confusion over the law, the Nuclear Regulatory Commission has not imposed violations or civil penalties. It has not imposed any civil penalties or significant enforcement actions for the reporting failures in at least eight years, the inspector said.”

There are two main issues here: there is concern for the brave workers and their safety and the concerns for community of residents. A secondary level of concern arises, when you begin to question what the companies know about exposure of any type to their workers, whether they are reporting these risks to the people who work for them, and whether the companies have known about defective or faulty equipment that could result in injury for some time. We can continue to speculate as to whether nuclear plants within the U.S. pose any type of serious threat to the community or its citizens, and the debate can continue to go either way.

But the fact that the U.S. is addressing these concerns as a whole and looking into whether the concerns raised are viable is a step forward. Should companies turn out to know about the potential dangers and yet continue to put people within their communities at risk, is something that needs to be addressed. Should their concerns be valid, there should be steps in place to protect the citizens, and I hope with the government’s involvement, this will be the case, and this disaster will serve as a warning to our country and to corporations who put money over the lives of their workers.

In my work, I see everyday working people, who have been exposed to toxic substances, whether I am representing clients in an asbestos exposure case, or a product liability case. When a corporation understands the dangers posed to their employees, yet continue to expose their workers without notice, is unconscionable.

Today there are 23 GE Mark I nuclear reactors operating in the U.S., including the Oyster Creek, New Jersey plant. Additionally, newer GE Mark II boiling-water reactors operate in both Limerick and Susquehanna, Pennsylvania. GE insists that these reactors have a track record of performing safely and properly; yet, concern continues to grow. My hopes are that these are just merely concerns that do not become a reality.

I would like to extend my condolences and support to Japan and the entire Pacific Rim, during this time as they proceed to recover from the earthquake and tsunami that rattled their country. The initial reports and news that follows covering the nuclear plant, present a devastating picture, for the people of Japan and for our future, should we not properly heed these warnings.

Asbestos On Broadway- Mesothelioma Preview

A number of years ago the famous actor Steve McQueen died from mesothelioma a form of cancer only caused by exposure to asbestos. At the time there was much speculation about the source of his exposure. Was it the snow that was used as a prop that was really asbestos? Was it the theater curtains he moved around? Several years later I was visiting London with my family and attended a play in the London Theater district. I was fortunate to sit close to the stage. As the band was warming up I noticed what appeared to be asbestos curtains. I knew this from my experience representing mesothelioma victims. So I went for a closer look. Sure enough the tag was still on the curtains indicating they were in fact made from asbestos and manufactured by a company known as Amatex. I thought to myself how primitive. These Brits obviously don’t worry about these things the way we do. The show was great and the people in London could not have been nicer.

This week I learned that there is a case pending in NY City of a person who claims to have developed mesothelioma from theater curtains. My first response was that this must have been a result of exposure to curtains removed long ago. Asbestos curtains must have been removed from Broadway long ago? Well apparently that is not the case. Apparently asbestos curtains will be removed from Broadway in 2011 in accordance with the following schedule:

Schoenfeld Theater – 236 West 45th Street New York, NYJanuary 7 at 10 am.

Music Box Theater – 239 West 45th Street New York, NYJanuary 21 at lO am.

Texas Dust Storms Unleash Red Dust Particles Causing Major Health Concerns for Residents of Texas Gulf Towns

The Associated Press released an article today titled, “Red Dust Worries Residents Near US Metals Plants: Residents Near Metals Plants In Texas And Louisiana Worry About Health Affects From Red Dust Storms”, which details the worries of the residents of Point Comfort, Texas and Louisiana. As the weather conditions over south Texas due to Tropical Storm Hermine continue to move inland, spreading torrential rain and high winds across the region, the residents of this Texas Gulf Coast town, worry about the effects that storms will have on the alumina refineries which populate their area.

The storms are creating hazy storms of dust, coating lawns, trucks and traffic lights, and thus are also coating the lungs of the people who live in these areas, according to the article. The article also points out that “it is unclear whether the red dust is harmful to health. Environmental regulators say the potentially dangerous metals found in the dust are in harmless trace amounts. Mannan, however, points out that even the most benign dust particles, in large quantities, can be detrimental to those with respiratory problems.”

According to the article, Terri Austin, who is a 47-year-old resident of Point Comfort, Texas worries about the affects of the red dust particles to her health. Her father who grew up in Point Comfort and worked for Alcoa for 30 years, died at age 65, seven years after he was diagnosed with an asbestos-linked cancer. According to the article, “like many structures built in the early 20th century, the plant was packed with asbestos.”

Also in Texas, within the bay’s sediment exist thousands of pounds of mercury that leaked for decades, making the area one of the nation’s largest clean-up efforts, according to the article, and also, a site known by the U.S. Environmental Protection Agency “so contaminate that they require complex, long-term cleanups.”

Eddy Arnold, Jr., a worker in the plant’s now shutdown alkaline facility said in the article, “I actually saw the beads of mercury running into the bay…I told my supervisor and he said, “well, you didn’t see anything.”

The unfortunate part of all of this is that it is currently unknown what the effects of the storms will be that will continue to hit parts of Texas and Louisiana the rest of the week, according to all news reports. The concern for residents remains about the health and well-being of themselves and their families and friends. The existence of mercury as well as asbestos, being exposed into the air is a major health concern. Even though, according to the article, “environmental regulators say the potentially dangerous metals found in the dust are in harmless trace amounts. Mannan, however, points out that even the most benign dust particles, in large quantities, can be detrimental to those with respiratory problems.” From experience with these cases, I know that we may not uncover the long terms effects of this storm, until 30 years later, or perhaps even longer.

Since the U.S. dries red mud which can turn into red dust and stored in reservoirs, breezy days such as these storms are producing, will continue to blow particles in the air, and we just don’t know how many people will be affected by this either through respiratory problems or asbestos-related diseases in the years to come.

Even though federal and state regulations require the cleaner operations on behalf of companies and are required to monitor the air emissions, groundwater and other pollutants, the regulators continue to fine corporations for violations. According to this article, “people generally keep quiet because they want to keep their jobs.” When the health and safety of their workers are at risk, it is an abolishment of decency for corporations and their corporate staff to not speak up, and in our experience, it may be years later, but eventually someone speaks, and the truth, whatever it may be, is uncovered.

Asbestos & Mesothelioma Pioneer Research Doctor Irving Selikoff Testifies in Landmark Case

The dangers of asbestos exposure were known to scientists and industry by the early part of the 20th century. The relationship between asbestos exposure and cancer was known and acknowledged by at least the early 1940s. In the 1950s, Dr. Irving Selikoff began his research at the Mt Sinai School of Medicine. While Dr Seikoff certainly did not discover the dangers of asbestos, he did more than any other human being living or dead to publicize the information on asbestos and disease and as a result changed the landscape of occupational medicine forever.

I had the privilege of getting to know Dr Selikoff personally and was able to proudly call him my friend. I spent may hours with Dr. Selikoff at his home and at his office discussing the need to educate and protect workers and the public from the ravages of asbestos exposure. The last project we worked on together was to obtain funding for molecular biological research on the cause of environmentally induced cancer.

Although Dr. Selikoff is acknowledged at the preeminent expert on asbestos related disease, he avoided working as an expert witness because it took time away from his research. New York Shipyard Responsible for Mesothelioma

The NY Shipyard in Camden New Jersey was at one time one of the busiest shipyards involved in the construction of navy and merchant ships. the use of asbestos was common place. In the last 6 months alone we filed suit for people diagnosed with mesothelioma. There have been dozens of other mesothelioma cases diagnosed as a result of asbestos exposure at this shipyard.

Asbestos Products List & Mesothelioma

Asbestos is a naturally occurring mineral that was used widely in products and industrial settings until it was eventually banned. Once hailed as “wonder mineral”, asbestos was utilized mainly for its durability and resistance to heat, making it a vital component of many manufactured goods, building materials, packaging, gaskets, coatings and friction products.

From 1900 to the 1980s, asbestos was used in more than 3000 products. In addition, more than 30 million tons of the mineral were utilized in schools, power plants, buildings, homes and industrial facilities. Unfortunately, when any of these products become disturbed, they release asbestos fibers which can be inhaled into the body and may eventually cause mesothelioma, asbestosis and lung cancer.

In this deposition we recently took Chevron admits that it did not  stop using asbestos in its Perth Amboy refinery until 1972,  more than 3 decades after learning that asbestos could kill. According to this witness there was more than 12 miles of asbestos on the piping alone in the Perth Amboy. This had the capacity to cause massive exposure to anyone in the area where asbestos was installed or removed.
